Terms and conditions

1. Acceptance of these terms

These Terms and Conditions (“Terms”) govern your use of the website www.jkitco.in (“website”), owned and operated by JKITCO Limited (“JKITCO”, “we”, “us”).

JKITCO Limited is a Public Sector Undertaking (a State Government company established in 1977), CIN U74210JK1977SGC000420. Registered Office: DIC Complex, Exhibition Ground, Jammu – 180 001. Corporate Office: 101, Classic Centre, 575, M.G. Road, Indore – 452 001, Madhya Pradesh.

By accessing or using the website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website.

2. Use of the website

You may use the website to learn about JKITCO, view tender notices, and contact us for lawful purposes. You must not:

  • break any law, including the Information Technology Act, 2000, while using the website;
  • try to gain unauthorised access to the website, its server, or any system or database connected to it;
  • upload or send viruses, malware or any code designed to damage, disrupt or overload the website;
  • use robots, scrapers or automated tools to copy content or submit forms in bulk;
  • submit false, misleading or impersonating information, or use another person’s identity;
  • send spam, abusive, defamatory or obscene content through our forms or e-mail addresses;
  • frame, mirror or copy the website, or present its content as your own.

We may block access, delete submissions or report the matter to the authorities if these Terms are breached.

3. Information on the website

General information. Content on the website is for general information about JKITCO and its services. We try to keep it accurate and up to date, but it is not professional, legal, financial or technical advice. Nothing on the website is an offer, commitment or contract by JKITCO; any engagement is governed only by a written agreement or work order signed by an authorised officer.

Enquiries and proposals. Sending an enquiry or proposal through the website does not create any obligation on JKITCO to respond, accept it or enter into a contract.

4. Tenders and procurement

The Tenders section of the website lists tenders, expressions of interest (EOIs) and requests for proposal (RFPs) issued by JKITCO.

  • Tender documents prevail. The notice inviting tender (NIT), the tender document and any corrigenda are the only binding terms of a tender. If anything on the website differs from them, the tender documents apply.
  • Changes to a tender, including extended dates, are published as corrigenda on the website and, where applicable, on the e-procurement portal. Bidders are responsible for checking for corrigenda before they submit a bid.
  • Bids must be submitted only in the manner, and by the date and time, stated in the tender document. Unless the tender document says so, bids or documents sent through the website’s forms or by e-mail will not be accepted.
  • E-procurement portals. Where a tender is run on a government e-procurement portal, that portal’s own terms apply to registration and bid submission.
  • JKITCO’s rights. JKITCO may amend, extend, cancel or re-issue any tender, and may accept or reject any bid, as provided in the tender document.
  • Website availability. JKITCO is not responsible for a bid that is late or incomplete because the website was unavailable, slow or could not be reached. Bidders should download documents and prepare bids well before the due date.

5. Your submissions and communications

When you send us information through the website or by e-mail, you confirm that it is true and that you are entitled to share it. Please do not send confidential, proprietary or sensitive information unless we have asked for it. We handle personal data as described in our Privacy Policy.

Suggestions or ideas you send us without a prior written agreement are not treated as confidential, and JKITCO may use them without any obligation to you.

Caution against fraud. JKITCO does not ask for any fee or deposit for job applications, appointments, empanelment or the award of work, except as stated in an official tender document. Official communication comes only from e-mail addresses ending in @jkitco.in. If you receive a demand for money or an offer in JKITCO’s name from any other source, do not pay; report it to bd@jkitco.in. JKITCO is not responsible for any loss caused by such fraud.

6. Intellectual property and linking

Ownership. The content of the website, including text, photographs, graphics, design and layout, belongs to JKITCO or is used under licence. The name “JKITCO” and the JKITCO logo may not be used without our written permission. Client and partner logos belong to their respective owners and are shown only to identify organisations we have worked with.

Permitted use. You may view, download or print pages for personal or internal reference, provided you keep the content unchanged and acknowledge the source as “JKITCO Limited, www.jkitco.in”. Any other use, including commercial use or republication, needs our prior written permission. This permission does not extend to third-party material on the website.

Linking to our website. No one may link to the website or any of its pages without JKITCO’s prior written permission. To request permission, write to bd@jkitco.in stating the page you wish to link to, where the link will appear and its purpose. Where permission is given, the link must not suggest that JKITCO endorses you or your organisation; our pages must open in a new browser window and must not be loaded inside frames on your site; and the JKITCO logo must not be used as a link unless specifically permitted. JKITCO may withdraw permission at any time, and the link must then be removed.

7. Third-party websites

The website may link to other websites, such as government portals, e-procurement portals and client websites. These links are provided for convenience only. JKITCO does not control those websites and is not responsible for their content, availability, security or privacy practices. A link does not mean that JKITCO endorses the website or its owner. Use of a linked website is at your own risk and under that website’s own terms.

8. Disclaimer, limitation of liability and indemnity

Disclaimer. The website and its content are provided “as is” and “as available”. To the extent permitted by law, JKITCO gives no warranty that the website will be accurate, complete, uninterrupted, error-free or free of viruses, or that it will meet your needs.

Limitation of liability. To the extent permitted by law, JKITCO and its directors, officers and employees are not liable for any direct, indirect, incidental or consequential loss or damage arising from your use of, or inability to use, the website or any information on it. This includes loss of data, profit, business or opportunity, and loss caused by reliance on website content instead of official tender documents. Nothing in these Terms limits any liability that cannot be limited under Indian law.

Indemnity. You agree to indemnify JKITCO and its directors, officers and employees against any claim, loss, damage or expense (including reasonable legal costs) arising from your breach of these Terms or your misuse of the website.

9. Availability, security and changes

Availability. We aim to keep the website available at all times, but it may be unavailable because of maintenance, technical faults or events outside our control. We may change, suspend or withdraw any part of the website without notice.

Security. We take reasonable steps to keep the website secure. You are responsible for protecting your own device and internet connection, and for using up-to-date security software when you access the website.

Changes to these Terms. We may update these Terms at any time by publishing the revised version on this page with a new effective date. Your continued use of the website after a change means you accept the revised Terms.

10. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or with the use of the website, are governed by the laws of India.

The courts at Indore, Madhya Pradesh, shall have exclusive jurisdiction over all such disputes and claims, and you agree to submit to the jurisdiction of those courts.

Disputes under a specific contract, work order or tender are governed by the dispute-resolution and jurisdiction terms of that document.

11. General

  • If any part of these Terms is found invalid or unenforceable, the rest remains in force.
  • No waiver. If we do not enforce a right under these Terms, we have not waived it.
  • Entire terms. These Terms and the Privacy Policy together form the full terms for use of the website. They do not replace any separate written agreement, work order or tender document between you and JKITCO.
  • If these Terms are translated, the English version prevails in case of any difference.
